Amtrak employee files suit after suffering traumatic brain injury

Traumatic brain injuries lead to devastating life changes for many people each year. Traumatic brain injuries are typically caused by an external force and often arise in personal injury cases. A TBI can occur as a result of slip and falls, motor vehicle accidents and workplace accidents.

When a brain injury is caused by the negligence of another party, victims may be able file a lawsuit against those responsible. An Amtrak employee who suffered a brain injury as a result of a derailed Amtrak train is now suing Amtrak for negligence. The accident made national news earlier this month when an Amtrak train traveling from Philadelphia to New York crashed, killing eight people and injuring over 200 others.

The employee was traveling for free and was off-duty when the accident occurred. The man alleges being violently thrown about the car and therefore suffering serious injuries. He was hospitalized at a local hospital, sustaining a traumatic brain injury in addition to orthopedic and neurological injuries, cuts and bruises and emotional trauma. The lawsuit states that the full extent of his injuries is not known at the present time. The employee is seeking more than $150,000 and punitive damages. The man’s wife is also listed as a plaintiff in the suit, claiming loss of consortium.

Serious TBIs, including severe concussions, can have lasting effects on a person, even if these effects aren’t evident right away. Recovering from a brain injury is often a long and difficult process for both the victims and their families.
